Google AdSense Ads as Pop-ups

Adimpact.com the company that introduced the floating layers using DTHML, has launched a new feature called AdSense Integration Tool.
It’s basically a new way of displaying AdSense ads on your site by placing them inside their floating creative. They claim this can reduce banner blindness and increase click through rates.
We know that it’s against the AdSense TOS to put ads in pop pus, but these aren’t popups by definition, they are simply DTHML layers that look like pop pups so they still abide by Google’s term and conditions or are they really?

lol, i won’t use it because it seems annoying enough to me. Furthermore the dhtml “pop-under” falls into a grey area.
It is STILL againsts AdSense TOS because it purposely draw attention to the ads.
Yes it’s the same with images next to AdSense because the purpose is the same, to draw attention to the ads. That’s why I don’t use it here
